APAP and Autism Litigation Update July 2024

Recent judicial developments have posed significant hurdles in the ongoing litigation regarding acetaminophen (APAP) use during pregnancy. Despite a challenging setback in federal court, Watts Law Firm LLP, alongside our co-counsel, remains committed to pursuing justice for those potentially harmed by prenatal APAP exposure. In December 2023, Judge Cote granted the defense’s Daubert motions, resulting in the exclusion of our general causation experts’ testimonies. This January, a subsequent order under Rule 702 led to the dismissal of all active federal cases due to a lack of admissible general causation evidence.  We are currently exploring new scientific evidence that could reinvigorate our case and are considering the possibility of refiling cases for minors in state courts. We are preparing for potential state court litigations and exploring appellate avenues.

Background and Implications of APAP Exposure During Pregnancy

This litigation stems from concerns about the safety of widely recommended acetaminophen during pregnancy. Scientific inquiries have suggested a possible link between APAP exposure and increased risks of neurodevelopmental disorders in children, such as Autism Spectrum Disorder (ASD). Despite acetaminophen’s reputation as a safe pain relief option for pregnant women, recent studies and expert opinions have called this assumption into question, advocating for more cautious use.
